Business Terms

These Business Terms govern the purchase and use of CyberProfile's recruiting product (the "Business Service") by organizations looking for talent. They form a contract between your company (the "Company") and Gorka El Bochi Morillo (empresario individual), tax ID 46099276P, registered address Carrer Romaní 15, 08184 Barcelona, España ("CyberProfile"). By creating an organization, purchasing a plan or using the Business Service, the Company accepts these Terms, the Privacy Policy and the Data Processing Agreement (DPA).

1. Purpose and acceptance

These Terms govern access to the Talent Pool of verified cybersecurity profiles, the management of hiring processes within the platform, and the recruiting services managed by CyberProfile. They complement, and for the Business Service prevail over, the general Terms of Service.

Whoever accepts these Terms represents that they have authority to bind the Company they represent.

2. Definitions

  • "Organization": the company account within the platform, holder of the plan and seats.
  • "Owner" and "Members": the people with access to the Organization, with different roles and permissions (owner, admin, recruiter, viewer).
  • "Candidate": the CyberProfile user whose professional profile may be shown to the Company.
  • "Managed services": tasks CyberProfile performs at the Company's request (shortlists, interviews, verifications, assessment reports, questionnaires), subject to plan quotas.
  • "Plan": the subscription tier purchased (Starter, Growth or Enterprise) with its scope of features, seats and quotas.

3. Onboarding, organization and roles

Onboarding is self-service: on sign-up, the Organization is created with the registrant as Owner. Access to real candidate data requires an active plan; without one, the Organization only sees the panel behind the paywall.

The Owner may invite Members and assign roles within the seats included in their plan. The Company is responsible for how its Members use the Service and for keeping their access confidential.

4. Plans, prices and billing

Self-service plans (Starter and Growth) are purchased and paid via Stripe. Prices are shown in the billing panel, with VAT added where applicable. The Enterprise plan is contracted bespoke.

The subscription is monthly and renews automatically at the end of each cycle using the registered payment method, until the Company cancels. Monthly managed-service quotas reset each billing cycle.

The Company must keep a valid payment method. If a charge fails, the plan may enter a grace period and, if not cured, be suspended.

5. Cancellation and refunds

The Company may cancel at any time from the billing portal. Cancellation takes effect at the end of the current cycle; the plan stays active until then and does not renew afterwards.

Unless required by law or expressly agreed in writing, fees already invoiced are non-refundable, including started cycles and managed services already delivered. One-off add-ons are non-refundable once the service is delivered.

6. Managed services and quotas

Each plan includes a monthly number of shortlists, interviews, verifications, assessment reports and/or questionnaires. Requesting one consumes a unit of the corresponding quota; once exhausted, the Company can upgrade its plan or buy one-off add-ons.

Managed services reflect real work by our team. Timelines are estimates and depend on Candidate availability. If a service is not delivered, the consumed quota unit is restored.

7. Use of the Talent Pool and candidate data

Access to Candidate data is granted solely for the Company's own legitimate hiring processes. The Company acts as an independent data controller for the Candidate data it receives and undertakes to process it in accordance with data protection law.

  • No scraping: extracting, bulk-copying, indexing or replicating the Talent Pool or the profiles is prohibited.
  • No reselling, transferring or sharing Candidate data with third parties outside the hiring process.
  • No using the data for advertising, spam or purposes other than the hiring for which access was granted.
  • Direct contact with a Candidate requires that the plan includes it and that the Candidate has consented; it must be limited to genuine job opportunities and respect the Candidate's wishes.
  • The Company must delete Candidate data when it is no longer needed for the process.

8. Company obligations

  • Provide truthful information about its identity and activity.
  • Comply with applicable law, including data protection and non-discrimination in hiring.
  • Not use the Service for unlawful, deceptive or harmful purposes towards Candidates or the platform.
  • Be responsible for its Members' compliance with these Terms.

9. Intellectual property

The platform, its software, brand and content are owned by CyberProfile or its licensors. During the plan term, the Company receives a limited, non-exclusive, non-transferable license to use the Service under these Terms. Candidate data belongs to the Candidates.

10. Confidentiality

Each party will treat the other's non-public information (including prices, assessment reports and Candidate data) as confidential and will not disclose it except to perform the contract or as required by law.

11. Availability and support

CyberProfile uses reasonable efforts to keep the Service available but does not guarantee uninterrupted availability or any specific hiring outcome. Support level depends on the plan. Enhanced service levels (SLA), if any, are agreed under the Enterprise plan.

12. Liability

The Service is provided "as is". To the extent permitted by law, CyberProfile is not liable for indirect damages, loss of profit or the Company's hiring decisions. CyberProfile's total liability arising from the Business Service is limited to the amount paid by the Company in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be limited by law.

13. Data protection

Processing of personal data under the Business Service is governed by the Privacy Policy and by the Data Processing Agreement (DPA), available at /en/dpa, which forms an integral part of these Terms.

14. Term, suspension and termination

These Terms remain in force while the Organization exists or keeps an active plan. CyberProfile may suspend or terminate access for a material breach (e.g. scraping, misuse of Candidate data or non-payment), giving notice where reasonable. On termination, the right to use ceases and the retention and deletion periods in the Privacy Policy and the DPA apply.

15. Changes

CyberProfile may update these Terms. Material changes will be communicated with reasonable notice via the panel or by email. Continued use after they take effect implies acceptance.

16. Governing law and jurisdiction

These Terms are governed by the laws of España. For any dispute, the parties submit to the courts of España, unless a mandatory rule provides otherwise.
